What’s New About the USPTO Trademark System?

The new system has a cleaner interface, but it’s also more particular about how you enter your information. There are new requirements, reorganized sections, and some unexpected changes that can trip up first-time applicants (and even experienced ones, just ask my legal assistant 😏).

In this video, I walk you through:

  • Logging into the new USPTO platform
  • Choosing the right filing basis and classes
  • Properly entering your goods and services
  • Uploading your specimen and dates of first use
  • Reviewing and submitting your application

I also share a few common mistakes that I’ve already seen people make with the new system — and how you can avoid them.

How to File a Trademark Application in the new USPTO system

I will be the first to tell you that the new system is a lot cleaner and (theoretically) easier to use than the old TEAS system. Instructions are much easier to read and links to helpful content and instructions are easy to access.

But before you head over to the USPTO office to start your application, here are some things you need to consider.

  1. Have you done a search first? This is extremely important and likely will require the help of a lawyer.
  2. Have you picked a name that is capable of trademark protection?
  3. Who is going to own your trademark? Keep in mind that your business owns your trademark, not YOU.
  4. What address are you going to use? If you want to protect your personal address, you will need to use a virtual address – but there are some tweaks you will need to consider to avoid an office action.
  5. What kind of trademark are you seeking to register?
  6. Have you thought about how you will describe the products or services you are selling (or are intending to sell)? Do you know which classes you need to include on your application?
  7. Have you begun selling your products or services? Do you have the proper evidence of your use in commerce?
  8. Are you prepared for the extensive filing fees (i.e. $350 per class that you include on your application)?

Why This Matters

Filing a trademark is more than just filling out a form — it’s a legal process that can have serious implications for your business. If you file incorrectly, it can lead to delays, refusals, or even a loss of your trademark. Not to mention the filing fees are 100% NON-refundable.

I will be the first to admit, the new USPTO system makes it look easier, but that doesn’t mean the process is foolproof. Taking a few minutes to understand the system before you dive in can save you time, money, and legal headaches.
